Terms of Use

Draft: this text will be legally reviewed before launch.

In short

Finally Lucid is a learning program for lucid dreaming with a dream journal. The journal, backup and export are free, and so is week 1 of the program. From week 2 on, you unlock the program in the App Store. Apple handles purchases, subscriptions and refunds. Your journal belongs to you and stays on your iPhone.

Who we are

These terms are an agreement between you and Simpdi Media LLC, 8 The Green, Ste R, Dover, Delaware 19901, United States ("we"). They apply to the Finally Lucid app and this website. How we handle your data is described in the privacy policy.

Apple's license agreement

You download Finally Lucid from the App Store. Apple's Standard License Agreement for apps (EULA) applies, and these terms supplement it.

What Finally Lucid offers

An 8-week program with lessons, exercises and alarm nights, a dream journal with voice recording, and the articles under Knowledge. The content is based on studies on lucid dreaming. How well and how quickly it works differs from person to person. We can't promise a lucid dream within a certain time.

Free and paid

The journal, backup, export and week 1 of the program are free. From week 2 on, you unlock the program with a yearly subscription, a monthly subscription or a one-time purchase. Current prices are shown in the app and on the pricing page. The one-time purchase unlocks the program permanently for your Apple Account, with no further payments.

Purchase and payment

You buy in the App Store, and Apple handles payment. We don't receive any payment data. Apple's terms for the App Store also apply to the purchase.

Subscriptions

A subscription renews automatically for the chosen period, one year or one month, unless you cancel it at least 24 hours before the end of the current period. Apple charges the amount to your Apple Account when you buy and at each renewal. You can cancel at any time in your Apple Account settings or in the app under Account & Settings → Subscription. The subscription then runs until the end of the paid period. If we raise the price of a running subscription, Apple informs you beforehand under its rules and asks for your consent where required.

Withdrawal and refunds

Apple's terms govern whether you can withdraw from a purchase or get a refund. For customers in the EU and the UK, they provide a right of withdrawal within 14 days without giving reasons. You submit the request to Apple at reportaproblem.apple.com.

Your journal

What you write and record in Finally Lucid belongs to you. We don't receive it and acquire no rights to it. Because the journal is only on your iPhone, we can't restore it. So turn on the iCloud backup or export your journal regularly.

Account

An account is optional. If you create one, please give true information, keep your password secret and use the account only for yourself. You can delete your account in the app at any time.

How to delete your account

Health

Finally Lucid is not a medical device. The app makes no diagnoses and doesn't replace medical or psychotherapeutic treatment. Alarm nights interrupt your sleep. Please read the health notice before practicing, and skip exercises that don't do you good.

Fair use

Please don't attack the app or our servers, don't bypass the lock on paid content and don't create accounts automatically. Decompiling or copying the app is only allowed as far as the law permits. We may block an account that breaks these rules.

Updates and changes

We provide updates so that Finally Lucid works as described and stays secure. A newer iOS version may be required for this. We keep developing the app and may change features. If a change would noticeably worsen what you paid for, we tell you beforehand. You can then end the contract under the statutory rules.

The account needs our servers. We make sure they run reliably but can't guarantee this at all times. The journal and the program don't need an account.

Warranty

The statutory rights for defects apply. If something doesn't work, email us at support@finallylucid.app.

Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under mandatory laws such as those on product liability, and where we have given a guarantee. For slight negligence, we are liable only if we breach an essential contractual obligation, meaning an obligation that makes the contract possible in the first place and on which you may rely. In that case, liability is limited to the damage that is typical and foreseeable for contracts of this kind. Your statutory rights as a consumer remain unaffected.

Ending use

You can stop using Finally Lucid at any time, delete your account and remove the app. You cancel a subscription separately with Apple. We may block or delete an account if someone seriously breaches these terms.

Apple

These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content. Apple has no obligation to provide maintenance or support for Finally Lucid. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Governing law

These terms are governed by the laws of the State of Delaware, United States. If you live in the EU, the EEA, Switzerland or the UK as a consumer, you keep the protection of the mandatory consumer protection laws of your country and can bring claims before the courts where you live.

Changes to these terms

We may change these terms for the future, for example when new features are added or laws change. We inform you about material changes in the app beforehand. Changes to your disadvantage apply to services you have already paid for only with your consent.
